    Individuals who still have the disabling impairment but have earned income that meets or exceeds the “Substantial Gainful Activity” level can continue to receive Medicare health insurance after successfully completing a trial work period.  The Substantial Gainful Activity level for 2014 is $1070 a month, or $1,800 for the blind.  This new period of eligibility can continue for as long as 93 months after the trial work period has ended, for a total of eight-and-one-half years including the 9 month trial work period.  During this time, though SSDI cash benefits may cease, the beneficiary pays no premium for the hospital insurance portion of Medicare (Part A).  Premiums are due for the supplemental medical insurance portion (Part B).  If the individual’s employer has more than 100 employees, it is required to offer health insurance to individuals and spouses with disabilities, and Medicare will be the secondary payer.  For smaller employers who offer health insurance to persons with disabilities, Medicare will remain the primary payer.
    How Electronic Claims Submission Works: The claim is electronically transmitted from the provider’s computer to the MAC. The MACs initial edits are to determine if the claims meet the basic requirements of the HIPAA standard. If errors are detected at this level, the entire batch of claims would be rejected for correction and resubmission. Claims that pass these initial edits, commonly known as front-end edits, are then edited against implementation guide requirements in those HIPAA claim standards. If errors are detected at this level, only the individual claims that included those errors would be rejected for correction and resubmission. Once the first two levels of edits are passed, each claim is edited for compliance with Medicare coverage and payment policy requirements. Edits at this level could result in rejection of individual claims for correction, or denial of individual claims. In each case, the submitter is sent a response that indicates the error to be corrected or the reason for the denial. After successful transmission, an acknowledgement report is generated and is either transmitted back to the submitter of each claim, or placed in an electronic mailbox for downloading by that submitter.

    Another important provision of the law is that insurance companies and agents are prohibited from selling a beneficiary a second Medigap policy.  An insurance agent is required to disclose this provision to Medicare beneficiaries and must obtain a written acknowledgment.  A new policy may be sold to replace an existing policy, but this fact must also be acknowledged in writing. When an insurance company or independent insurance agency sells such a policy, they must disclose to the purchaser the specific coverage and certify that the policy is not a Medigap policy.
